Northampton County judge rules there's enough evidence in suit over student's poor grade to move forward

Northampton County Judge Emil Giordano declined Lehigh University's request to dismiss a case against the university alleging one of its faculty rigged a student's grade.

Following a 15 minute recess after the request, Giordano ruled there was enough evidence to proceed. 

Earlier today, Northampton County Judge Emil Giordano expressed concern about ordering Lehigh to change the grade of Megan Thode, who sued to bump up a C-plus grade she received in the fall semester to a B.

She claims the student-teacher in her graduate-level therapist internship course retaliated against her for supporting gay marriage. University officials and the student-teacher have disputed the claim in testimony.

A bench trial regarding the case started this week.

This afternoon, Lehigh University attorney Neil Hamburg asked Giordano for a summary judgment, citing there are no grounds for the trial to proceed.
