An arbitrator has ruled that a northern New Jersey elementary school teacher should lose his job due to his bad temper, profanity and incompetence.

But the teacher's attorney says his client will appeal the decision.

The Record reports that the ruling cited Paterson teacher Robert J. Carter's inability to control his students, at times swearing at them or slamming a chair on the floor to stop them from misbehaving. It also said he didn't supervise them carefully enough to catch them watching pornography online and inappropriately sought bereavement leave when pop singer Whitney Houston died.

The ruling issued late last month is one of the first cases decided under the state's new tenure law, which aims to expedite a process often criticized for being so expensive and time-consuming.
