Attorneys for Tim Curley, Gary Schultz call Freeh report 'flawed'

The lawyers for Penn State administrators accused of lying to a grand jury and not reporting suspected child abuse by Jerry Sandusky said today a report critical of their clients’ actions did not show the full picture.

The attorneys for athletic director Tim Curley and retired vice president Gary Schultz said the investigation led by former FBI director Louis Freeh was flawed.

Curley lawyer Caroline Roberto said Freeh’s investigators were limited by lack of subpoena power and did not speak to critical witnesses.

“The result is a lopsided document that leaves the majority of the story untold,” Roberto said.

Tom Farrell, Schultz’s lawyer, said there was no effort by Schultz, Curley, football coach Joe Paterno or university president Graham Spanier to hide Sandusky’s behavior.

“Absent the opportunity to interview critical witnesses, including, but not limited to Mike McQueary, Chief of Police Tom Harmon and former Assistant District Attorney Karen Arnold, the Freeh Report, like the grand jury presentment, does not provide a comprehensive rendition of the facts,” he said.

McQueary came to Paterno with a report of Sandusky in the shower with a young boy in 2001. Arnold reviewed a 1998 complaint by a woman whose son had showered with Sandusky, but no charges were filed after a police investigation.

Curley and Schultz are awaiting trial, and there was a scheduling conference with the Harrisburg judge on Wednesday, but a trial date had not been set.
